Data Privacy Brasil and InternetLab file Amicus Curiae at the Supreme Federal Court (STF) analyzing the use of secret monitoring tools
Data Privacy Brasil and InternetLab filed an amicus curiae brief regarding the Claim of Non-Compliance with a Fundamental Precept (ADPF) 1143, proposed by the Office of the Attorney General (PGR), which addresses the regulation of the use of government hacking tools and monitoring through spyware on personal communication devices by public agencies and agents.
The contribution to the Court was organized into 4 main chapters: I – The International Industry of Vulnerability Exploitation: Classification and Frequent Uses of Spyware; II – The Use of Spyware in Light of Fundamental Rights; III – Analysis of the Necessity and Proportionality in the Use of Spyware in Criminal Investigations; IV – The Residual Hypothesis of This Court Deciding on the Necessity of Using Spyware Tools.
